【18:19】「立場新聞」、前總編輯鍾沛權和署任總編輯林紹桐被判串謀發布煽動刊物罪成,歐盟對外事務部發言人回應說,裁決是香港新聞自由收窄的又一例證,也恐怕會進一步限制意見多元交流及資訊自由流通。

歐盟在新聞稿中呼籲,香港當局停止檢控新聞工作者,及恢復對香港新聞自由的信心。發言人稱,保障自由、獨立及多元的傳媒,對健康及強韌的社會是至關重要。

【17:45】警方國安處總警司李桂華回應裁決時提及,警方執法時被部分人批評打壓新聞自由,而法庭的判辭正好反映警方當初執法的理據及急切性。至於涉案11篇被指有具煽動意圖文章的作者或記者會如何處理,他指會視乎相關人士有否煽動意圖,若認為相關人士有煽動意圖,警方將與律政司進一步商討。

李桂華又認為,判辭清晰交代違法界線,指出若新聞機構利用事件為載體散播煽動信息就屬違法,並非限制傳媒報道特定題目或案件。(詳細報道)

【17:10】鍾沛權離開法庭,其間未有發言。

【17:04】政務司長陳國基回應記協聲明指,特區尊重及重視新聞自由,法律亦有所保障,所有記者只有依法及依事實報道,又指在本港並非不可批評政府,但要視乎批評的目的。他指相關案件必定經法庭審訊而定罪,不會隨便。

【16:35】記協發聲明指,案件反映香港新聞自由衰落,裁決前亦已對香港新聞業界造成不可逆轉的傷害。記協強烈反對當局以煽動罪、《港區國安法》及《維護國家安全條例》等法例檢控按《基本法》行使權利進行新聞工作的人士。

【16:16】郭官聽畢求情後,表示要索取林紹桐的醫療報告,並指其裁決已處理「立場」成立以來的編採方針、公信力、當時民情等議題,辯方可審視。辯方稱稍後會呈交醫療報告和案例。郭官將案件押後至9月26日下午2時半判刑。在控方不反對下,兩名被告獲准保釋等候判刑。

鍾沛權陳情信節錄如下:

○提及妻子陳沛敏採訪日本311大地震時成為最後離開日本的其中一名香港記者,稱她相信假如日本出現更大災難,她更應留下繼續採訪,認為妻子作為一名記者,「怎可以轉身離開?」

○認識不少香港新聞工作者,包括很多立場新聞前同事,在過去和現在都抱持相似的信念,決意留守新聞現場,見證和記載真實故事,聆聽和記述紛紜的思想。相信這故事和思想,可以刺激、啟發人們思考,反映時代,塑造歷史。

○我知道有更多並非新聞工作者的香港人,同樣一直堅持在各自的崗位上實踐信念。他們當中更有人因為在乎社群裏眾人的自由和尊嚴,不惜付出失去一己自由的代價。如實記錄和報道他們的故事和思想,是新聞工作者不可逃避的責任。

【16:18】無國界記者譴責裁決,認為裁決再度衝擊本港新聞自由,亦立下壞先例,質疑日後任何不緊隨官方立場的事實報道都可能觸犯煽動罪,促請香港政府停止利用法律騷擾兩名涉案新聞工作者,並且停止「邪惡地(nefarious)」針對新聞自由。

【16:00】辯方資深大律師余若薇求情指,本案與以往煽動案不同,兩被告是新聞工作者,涉案文章並不是如以往的煽動文章般具宣泄性,或表達特別立場,望法庭能考慮案件的嚴重程度及受責程度。余續指,鍾及林在被捕後分別已還押300多天,本案最高刑罰為監禁兩年,若在獄中良為良好則可獲3分1的刑期扣減,則等同兩人已監禁16個半月及15個月;而在23條通過後,與國安相關被判入獄的案件未有人能獲刑期扣減。

辯方重申,本案根本不應判處最高刑期,而兩名被告若獲行為良好扣減,則已還押的日子已經多於刑期,望法官能判處的判期不會超過兩人已還押的日子。

余續指,立場新聞在兩被告被補後隨即停刊,鍾由2021年至今沒有任何工作和入息,其太太仍就《蘋果日報》被控串謀勾結外國勢力案還押。而另被告林紹桐則患有嚴重疾病,現須接受化療,若被判監則難以接受治療。林已婚、育有一名年幼的女兒,他亦於本案案發後失去工作,現時有少量兼職工作、入息不多,案件對林造成經濟打擊,他亦因而失去以奬學金到外國著名大學深造的機會。

【15:53】控方表示將引用國安法實施細則,向「立場新聞」母公司申請充公令,要求法庭頒發罰款裁決,稍後排期處理。辯方透露,林紹桐直至9月中仍有病假,希望法庭另定日子判刑,其間批准兩名被告保釋。

庭上讀出林紹桐撰寫的陳情信,節錄如下:

○我依然記得還押最初與警官會面,其中一位形容大家「各為其主」。我後悔當時無把握機會向警官解釋,新聞工作者從來無效忠哪一個、與哪一個為敵。如果有真正效忠對象,只能是為了公眾,因信奉新聞自由、言論自由,唯有傳播思想的自由,先能夠保障每人的自由。

○我於2012年加入新聞業,新聞界面臨各種隱憂,或明或暗。編採室方針難逃老總、財團左右,編輯自主空間愈來愈狹窄。「立場新聞」在如此背景下成立,參與「立場」的每一位抱持同一理想。

○「立場」能夠生存七年,好大原因是讀者想看的新聞,真正不受財團、金主或黨派左右。即使在最後的時間,新聞自由在半空中墜落,我們在巨大壓力下仍然堅持,無愧於時代。我們發掘差點被掩沒的真相,為無權者、弱勢發聲。即使面臨攻擊,我們盡可能趁人和事消失之前留下歷史的初稿。每一同事都心知肚明,我們選擇留下,用盡狹縫裡所有的空間。

○由2020年7月,控方指控干犯煽動控罪開始,「立場」報道獲30多項新聞獎嘉許。曾與一群出類拔萃的新聞工作者並肩工作是我的榮幸。本案關鍵是新聞自由和言論自由,新聞工作者不單要為報道負責,明知公眾有知情權而刻意迴避不報道,就是失職。

○正如今日仍然謹守崗位的每一位新聞工作者,我只是行業中其中一個人,剛巧成為被告。

【15:46】法官郭偉健裁定,涉案17篇文章中有11篇具煽動意圖,包括何桂藍專訪、陳沛敏、區家麟等人撰寫的博客文章。

【15:38】開庭。裁決顯示鍾沛權、林紹桐及立場新聞母公司均罪名成立。法官郭偉健甫開庭表示,知悉被告林紹桐無法到庭應訊。辯方資深大律師余若薇指,早前呈上醫療報告和信件,多謝郭官容許林缺席。庭上透露,罪成的鍾沛權和林沒有案底。鍾沛權聞判後表情未有改變,不時望向旁聽席;林紹桐則因病未能到庭,其辯方代表在庭上代為讀出求情信。

【14:54】案件原定下午2時半開庭裁決,至目前仍未開庭。

【14:30】另一被告、時任署任總編輯林紹桐未有到庭;正庭旁聽席近乎滿座。

【14:20】被告之一、立場前總編輯鍾沛權到庭,坐於被告欄內。

【14:15】國安處總警司李桂華到庭,坐在控方代表後方。控方代表署理高級助理刑事檢控專員伍淑娟、辯方代表資深大律師余若薇亦到庭。

【14:05】區院內有約10名軍裝及便衣警員,多國領事和代表包括法國領事、數名立場新聞前員工、前議員邵家臻、社運人士雷玉蓮等相繼到庭旁聽。而早前警方曾拉起橙帶。

【13:59】全數165張公眾籌已派發完畢,公眾陸續入庭旁聽。曾為「立場新聞」撰文、撰寫其中4篇涉案文章的傳媒人區家麟、前記協主席岑倚蘭和陳朗昇等到庭旁聽。

【13:45】傳媒及旁聽人士開始入庭。據正庭所見,記者席已坐滿,旁聽席暫有數十個空位。旁聽者中有近20人戴上口罩,多同坐於旁聽席的左上部分,部分人早前排隊時未有回應記者提問,僅擺手搖頭。

裁決摘要指,考慮到《立場》的媒體路線,裁定鍾沛權審批發布10篇具煽動意圖的文章、知悉及認同文章煽動意圖,提供《立場》作發布平台,意圖煽動憎恨中央或香港政府、激起香港居民企圖不循合法途徑促致改變依法制定的事項及憎恨司法;至於林紹桐,判辭稱他在鍾離任後接管總編輯職務,審批發布一篇具煽動意圖的文章,考慮林出席網媒論壇高峰會發言支持反修例運動、發布有關中大衝突兩周年文章時嵌入錄影片段重新展示抗爭口號標語,以及在警方去信投訴涉事文章誤導偏頗下仍堅持發布,同樣裁定其知悉及認同文章煽動意圖,提供《立場》作發布平台。

案件引起公眾關注,早上9時已經有市民到庭外等候旁聽。吳先生於早上7時從新界到區院候籌,他表示自己是立場新聞讀者,特意請假到庭支持兩名被告,而過往曾聽審此案約10次,亦會關注其他人被控暴動的案件。本案是回歸後首宗傳媒被控煽動的案件,他認為兩名被告「無做錯到」,相信他們只是報道事實,並負責轉載文章,若因此斷言他們支持文章作者及發布煽動文章,整件事「唔合理」,憂只會令日後新聞變到「只有一種聲音、政府想睇到嘅文章」。

上午11時,到區院候籌者漸增,有意成為記者的中大新聞與傳播學系三年級伍同學表示,過往都有留意案件發展,知道今日裁決,特意到庭聽審,認為「成單案根本唔應該擺上法庭」,不明白被告違法之處,若法官裁定二人有罪,冀聆聽當中解釋,「係個學嘢嘅機會」。已退休的陳先生則認為本案有不公之處,形容現時心情矛盾,一方面希望兩名被告無罪釋放,另一方面又相信法官會判處二人罪成。常旁聽案件的「姨婆」亦有到場輪候,她曾於今年6月4日於銅鑼灣手持《香港國家安全法解讀》,並與同行人士高呼「支持國安法」後被捕。她表示該事件不會影響她到庭聽審的動力,並會繼續支持各被告。
