運輸及物流局長陳美寶今午被問到對裁決回應時,稱法庭正宣判,政府將密切留意及審視法庭判決,待判決完畢後再回應。 周官甫開庭稱,本案源於港燈「南丫四號」及港九小輪「海泰號」於2012年10月1日晚上相撞,南丫四號在118秒內沉沒海牀,奪去39條人命;其中8名死者為小童,另有97人受傷。周官指,兩船的船長及兩名海事處人員遭刑事檢控,死因庭原本拒絕展開研訊,及後上訴庭裁定遇難者家屬上訴得直,本研訊得以召開。 周官表示,本案有別於一般研訊,調查範圍限於上訴庭接納的6項議題,包括財利船廠最初是否知道南丫四號要裝「水密門」。研訊傳召84名證人作供並有364份證物呈堂,有關鍵證人因年事已高或身體不佳而無法出庭,亦有證人不知去向。周官認為事隔多年,不少人的供辭有缺失與矛盾之處。 法律原則方面,周官表示死因庭旨在查找事實,有別於刑事審訊,惟根據刑事定罪紀錄,海泰號船長事後裁定39項誤殺罪成,南丫四號船長則裁定「危害他人在海上安全」罪成,前者的嚴重疏忽構成誤殺,顯然罪責更重。周官稱,海泰號船長的作為在刑事標準下構成誤殺,在民事標準下同樣適用,遂認為39名死者非法被殺。 遇難者家屬Alice在裁決前受訪,她說追求公義之路曲折漫長,胞弟用生命揭示驗船漏洞,期望裁判官除了判定死因,亦跟進海事處有否彌補制度錯誤。另一家屬全叔說,與其為悲劇畫上句號,不如「打一個問號」,問政府如何追究失職官員,以及何時公開「封塵」多年的內部調查報告。 死因研訊聚焦6項議題,包括財利船廠最初是否知悉「南丫四號」兩艙之間通道會裝水密門。遇難者家屬和海事處代表均在結案陳辭表示,該船最初計劃建造水密門,質疑財利董事羅愕瑩庭上撒謊,即訛稱早年已決定不設水密門。家屬方批評羅編造說法,只為掩飾疏忽或避免刑事調查。此外,海難矛頭指向海事處人員多年驗船未察覺水密門問題。 案件裁決最初定於2025年11月13日,其後兩度延至11月27日及12月4日,最終第三度押後至2026年1月21日。 Source link
