南丫海難死因裁決 官:要求海事處驗船年檢核對圖則「不切實際」 在席家屬全體離庭 (16:04) – 20260122 – 港聞 – 即時新聞

死因研訊審視39人死因,裁判官周慧珠昨先處理「消失的水密門」議題,今繼續宣讀另外5項議題的裁決。周官裁定,時任財利船廠船舶工程師、來自西班牙的Jon Leizaola自稱只負責行政工作,但根據其資歷和職位,他顯然嘗試減低自己的角色,與海難劃清界線。周官認為,準備穩性計算書的財利前繪圖員張福初,無將責任推卸予Leizaola,關鍵是財利內部欠缺清晰分工,張僅接受上司指派的工作,並未考慮對方會否核查數據。 針對海事處年檢或隔年一次的檢查,有否檢視「南丫四號」艙壁,家屬方提出驗船人員應盡職檢查結構及水密設備,有助揭發兩艙通道無裝「水密門」。周官裁決指,當時法規無要求船隻裝水密門抵擋「兩艙入水」,專家曾稱加裝水密門並非解決方法,減壓或增設浮力設備才能應付「一艙入水」,因此家屬指控海事處未檢驗水密門,說法站不住腳。 周官表示認同海事處及港燈所指,家屬要求驗船官年檢時核對圖則,確保船身與最初圖則一致,屬不可行及不切實際的要求。周官稱,海事處初次驗船的目的,是確保船隻符合圖則設計與法例,年檢則旨在檢驗船隻狀態,例如有否損壞或非法改動;若要求驗船官年檢時重新檢查結構,會混淆兩種驗船程序,「亦會分散驗船官的時間及精力」。 在席家屬今午在法官宣布裁決時,全體離開法庭。 圖為南丫海難死者家屬徐志盛。(李紹昌攝) 周官形容,家屬「事後孔明地要求採用完美標準驗船」(demands mere prefect scrutiny carry out with benefit of hindsight),未有考慮驗船人員每日檢驗不同船隻。多名遺屬連日在家屬席旁聽,周官讀出海事處驗船方面的裁決後,在席者全體步出法庭。在海難失去胞弟的梁淑玲一度激動飲泣;失去胞兄及侄女徐志盛庭外表示,死因庭指家屬的要求不切實際,有家屬「拍枱走人」。 周官表示,時任高級驗船主任梁維學在2013年調查委員會聆訊及死因庭證供不一致,梁在研訊自稱不知道「船總長度一成」規定,1996年審批穩性計算書時無應用規定,直至海難才知悉;惟梁在委員會聆訊清晰講述規定,亦確認曾簽署審批文件。周官認為,梁具有船舶工程師等專業資格,其證據矛盾「難以合理歸咎於記憶流逝」(cannot reasonably be explained as lapse of memory)。周官稱非常關注梁在死因庭是否誠實作證,將轉介律政司跟進。 「任何裁決及建議都無法抹去家屬的傷痛」 周官在結語表示,海難奪去39條人命,「任何裁決及建議都無法抹去家屬的傷痛」,寄望死因研訊查清事件,確保各方汲取教訓。周官稱,希望39條性命能提醒所有造船廠、船舶營運商、監管部門及社會大眾致力保障海上安全,並向死因庭專家、水警及法醫等致謝。 周官提出14項建議,包括海事處須繼續與船廠、營運商和專業團體保持溝通,確保對實際規則有清晰理解;海事處要實施申報系統,要求船東每次定期驗船前,確認自之前驗船以來有否進行任何改動,以便妥善記錄和規管改裝項目;處方向主要渡輪營運商諮詢後,繼續檢討海員工時和休息安排。 周官亦建議,財利船廠和所有同類型造船廠,須將船舶建造審批後進行的任何改動通知海事處;船廠要為每艘建造中的船隻採用「檢查與測試計劃」,應提供一份全面清單,列明所有需要檢查及測試的項目;船廠亦要建立一個中央檔案庫,為每艘船舶在整個服役生命期保存所有設計圖紙及穩性數據。 另外,周官建議港燈確立正式的船舶驗收和移交程序,以確保每艘新船都經過獨立驗證,核實符合規格和海事處審批的圖紙。周官亦建議港九小輪及其他渡輪營辦商,透過定期簡報,加強海員對疲勞的認知。 Source link

陳美寶指古洞站項目目前進度良好,料可在明年投入服務,配合古洞北新發展區主要人口遷入時間。她續指政府已於去年與港鐵簽訂第一部分項目協議,合作推動北環線支線工程,使其時間表可提前兩年,望可與主線同步開通。陳表示當局會與港鐵共同分階段研究開通的可行性,考慮因素包括整體的技術可行性、新發展區其他工程銜接等。 選委界議員陳紹雄則關注古洞站開通後,東鐵線有否足夠運力應付粉嶺北新發展區約20多萬的新增人口,他引述2024年東鐵線列車數量為37架,載客率以每平方米站立4人來計已達94%,問到當局如何評估古洞站開通後的乘車數量、需否新購東鐵線列車數量、屆時載客率及每班車的候車時間等。 陳美寶則表示當局需與港鐵「超前部署」,留意到東鐵乘客量一直有上升,當中不乏跨境乘客,港鐵在2024年3月及8月均分別加強東鐵線的列車服務,當局亦調整前往羅湖站和落馬洲站的列車班次運作比例。她提及東鐵線新信號系統容許有42班列車同時運作以達至最高2分鐘一班車的班次,當局與港鐵商討後,認為未來有需要增購列車應付新古洞站帶來的客量,她強調當局會平衡利益及成本。 圖為港鐵古洞站地盤。(資料圖片) 陳美寶續指未來數年,粉嶺北及古洞北兩個新發展區的項目會分兩階段入伙,第一階段將於今年中起至明年,新增人口約為5.5萬人;第二階段將於2030年至2032年,新增人口約17萬。她稱當局已制定多方面措施應付市民出行需要,包括今年內通車的粉嶺繞道東段,將會直接連向粉嶺北新發展區及粉嶺公路。她又提到當局亦有多項道路改善工程,包括興建寶石湖路行車天橋繞道等,運輸署已因應兩個新發展區的第一階段入伙規劃開辦6條專營巴士路線,接駁古洞北和粉嶺北到上水或粉嶺地鐵站,以及北區醫院等主要社區設施。 陳美寶稱過去3年新界北新入伙的房屋發展項目主要包括上水的清濤苑及彩石邨,新增人口約9400人,運輸署已提前在專營巴士營辦商的年度路線計劃作規劃,包括在2024年9月新增巴士服務來往清濤苑及上水地鐵站,以及在上月開辦一條專線小巴路線來往彩石邨及石湖墟。 議員關注北環線延線進展 新界北議員譚鎮國則關注北環線東北線及東延線的進展,包括推薦模式、財務安排及走線有否初步定案。陳美寶重申當局以「共同開通」作為基礎,因當局需要推前支線開通日期,主線沿線新發展區亦有分階段入伙,故當局將與港鐵研究分階段開通的可行性,需顧及整體技術可行性;她又認為分階段開通或會影響整段路線作「聯調聯試」的時間,以致拖慢其他方面,因此當局需要整體評估。 新界西北莊豪鋒質疑政府規劃「厚此薄彼」 洪水橋欣澳鐵路「無聲氣」 新界西北議員莊豪鋒則關注「洪水橋欣澳鐵路」的進度,他提到數年後屯門南、元朗南、錦田南洪水橋/廈村合共將會有五、六十萬新增居民,又指「洪水橋至前海鐵路」將會帶數百萬深圳乘客到洪水橋站,「逼上呢條插針都插唔入」的屯馬線,惟用於分流的「洪水橋欣澳鐵路」現在「乜嘢聲氣都無」。陳美寶回應稱,當局在規劃整體重鐵網絡時,傾向增強韌性及達至完整性,當局冀透過屯門南沿線和新界西其他鐵路發展項目落成,完善整體公共交通配套,並引入新一代的交通運輸樞紐及服務交匯處。 Source link
