A Wichita Falls woman has sued the Sam’s Club here over injuries she contends she suffered from a fall in the store, court records show.
The lawsuit was filed in 78th District Court on Wednesday.
The lawsuit said Susan Awtry was shopping in the store at 3801 Kell East Boulevard on Dec. 26, 2024, and went to the bathroom.
“There was a change in level from the concrete floor of the store to the tile flooring of the bathroom entrance, causing Plaintiff to fall at the elevation change, resulting in injury to the Plaintiff,” the lawsuit alleges.
A photograph included in the suit shows a measured distance of approximately one-half inch between the concrete floor and the tile floor.
The restroom entrance was not up to Texas accessibility standards, and Awtry suffered due to negligence on the part of the store, the lawsuit alleges.

Awtry suffered injuries to a hand, shoulder, arm, elbows, head, wrist, leg and foot that “may be permanent in nature,” the lawsuit contends.
“Plaintiff would further show that Plaintiff endured physical pain and suffering, mental anguish, disfigurement, and physical impairment since the time of the fall, which in all reasonable probability will continue in the future,” the lawsuit alleges.
Awtry is seeking up to $1 million in damages. She is represented by attorney David M. Nix.
